They can't ban you because you didn't agree to follow the rules, and they recognize that you disagreed to follow them. Thus there is no actual disagreement. And you can not be held responsible.

The Summoner Code is like a club for people who are happy to show their support for the Forum Guidelines.

This is like saying they can't find you guilty of a traffic crime because you don't have a license and didn't agree to follow the rules. Once you put the key in the ignition, you are held responsible for your actions.
